A step closer to pavement parking legislation being changed

We welcome government’s long-awaited consultation on whether legislation on pavement parking should be changed.  We have consistently called for a clear and consistent UK-wide common standard that enables local authorities to manage and enforce parking on footways, with the presumption being that obstructive/pavement parking is not allowed.

Many towns and cities were not designed to accommodate today’s high levels of vehicle ownership. In some residential areas with narrow roads and no driveways for example, the pavement is the only convenient place to park for a motorist without obstructing the carriageway. However, pedestrians have needs too and it is unsafe for them to have to move into the road when a car is parked on the pavement.  It is especially hazardous for people with visual or mobility impairments, those assisted by guide dogs, and wheelchair and mobility scooter users.  Damage to the pavement and verges is also a financial burden to local authorities, both in terms of highway maintenance and personal injury claims.

Our UK-wide study found the majority of people wanted anti-social parking to be dealt with where pavement parking, congestion caused by school runs and parking too close to junctions were together cited by 56% as the ‘most urgent’ issues which need addressing

Also our recent survey of local authorities explored the problems caused by pavement parking, the effectiveness of current legislation, and the case for reform. The findings confirmed that vulnerable pedestrians are most at risk, and in particular, people with visual impairments, people who use mobility aids, including guide dogs, wheelchairs, and mobility scooters, young children and people with prams and pushchairs.

We recommend the government continue to work on reforming and simplifying the TRO process. And have been working closely with DfT to see how the TRO legislative framework can be improved, to make TROs easier to implement which will in turn help to manage pavement parking as well.
